In the Matter Between Notwane, BFA NEC & BPL

In The Matter Between Notwane Fc (Applicant) And The Bfa Nec (Respondent), Bpl (interested party)

In the urgent application matter that was brought before the Botswana Football Association Disciplinary Committee by Notwane Football Club against the BFA National Executive Committee as respondent and the Botswana Premier League as interested party which matter was heard on the 09th August 2018, the Disciplinary Committee (DC) heard both the issue of jurisdiction and merits of the application, and came to the following conclusion:

  1. That the Committee has no jurisdiction on the matter that was brought before it;
  2. That even if the Committee was to be found to have erred in coming to the conclusion that it does not have jurisdiction on the matter, the application will still fail on merits as the applicant had failed to advance convincing reasons sufficient and compelling to enable the committee to rule in the Applicant’s favour;

Based on the above, the plea by Notwane Football Club that they be invited to the BFA Annual General Assembly to be held on the 11th August 2018 by virtue of having gained automatic promotion to the Premier League was dismissed.
